Who can adopt in France?
- The first requirement is to be over 28 years old. On the other hand, the law did not provide for an upper age limit to adopt but the family, the bodies authorized foradoption and many foreign countries, for example, refuse to entrust a infant to parents over 40 years old.
- Married couples over two years old or older than 28 years old. In the case of two married persons, however, the adopter must receive the green light from his spouse. Note that the age requirement disappears if the couple has been married for more than two years.
- Singles have the right to adopt but face more difficulties than married couples.
- The situation is complex because the PACS appears on your birth certificate, which means that for many countries, you are neither single nor married: this excludes you, legally, from theadoption in almost every country. This does not mean that theadoption is definitely impossible, but the course will be extremely difficult and uncertain. In France, the couples pacsés are with regard to theadoption exactly in the same situation as cohabiting couples.
- The adopter must be at least fifteen years older than the child to be adopted, unless the adopted child is the child of the spouse. The minimum age difference is then only ten years
It must also be justified :
- a good reputation (social survey);
- good health (medical examination);
- a good psychological balance (examination with a psychologist).

If one of the spouses wants to adopt the child of his spouse, he can do it even if he is not 28 years old.
Cohabitants can not adopt a child together. The latter can only be adopted by one of the cohabitants. PACS partners (civil solidarity pact) are in the same situation.
Two types of adoption are recognized in France
There is theadoption plenary : the adopted child loses all connection with his family of origin and has the same status as a legitimate child. Theadoption Plenary is irrevocable and final.
There is theadoption simple it creates a new relationship of parentage between the adopter and the adoptee. But it does not break the ties of filiation between adopting it and its family original.
